Primary Function

Issues subcontracts under client prime contracts for goods and services of a moderate to high complexity and risk to the business unit. Subcontract activity may be non-routine and require development of specialized and or complex contract vehicles and techniques to accomplish business goals and objectives. Applies Battelle policies, procedures and practices to the business situation. Displays independent judgment and analysis of significant issue identification and resolution. May recommend development of new subcontract processes or assessment of required deviations from established norm. Acts as a resource for advice, counsel and guidance.

Major Responsibilities

Drafts and negotiates moderate to high complex procurement instruments to include the following responsibilities:

  • Prepares solicitations and ensures completeness and responsiveness to vendor and internal client needs.

  • Ensures solicitations conform to corporate policy, business, financial, contractual and risk perspectives and may contribute to the development of the general procurement strategy.

  • Identifies appropriate procurement type to achieve intended results and mitigate risk. Reviews the Statement of Work (SOW, schedule and deliverables) and drafts appropriate solicitation/procurement documents.

  • Reviews Battelle’s client contract or RFP to assure all flow-down terms and conditions, tailored to circumstances are included in the RFP request to the vendor.

  • Analyzes procurement requirements, special provisions, and terms and conditions to ensure compliance with appropriate laws, regulations and Battelle policies.

  • Drafts/develops, negotiates and administers contractual agreements for assigned programs.

  • Initiates negotiations with vendor for agreement terms and pricing.

  • Develops solutions to problems encountered in negotiations.

  • Maintains procurement files in an audit-ready condition, conforms to standard practices and Battelle operating procedures and in a manner consistent with legal requirements for maintaining approved purchasing system status.

  • Works with proposal teams on a wide variety of major proposal efforts ranging from standalone contracts to multi-million dollar IDIQ efforts.

  • Assists with the Price to Win Strategy and Performance Strategy as it relates to Subcontractors or Team Members.

  • Issues and negotiates Teaming Agreements and Confidentiality Disclosure Agreements (CDA’s).

  • Identifies compliance problems and develops solutions for approval of high level staff/management.

  • Develops solutions in solving problems that may arise during project performance. Resolves problems with Accounts Payable on supplier invoice payment issues, as required.

  • Analyzes new law, regulation and contract trends for potential impact on procurement goals and objectives.

  • Assists in identification, development and implementation of new procurement policy and processes.

  • Assist senior procurement staff and/or other technical, support, or management staff of market, technical, and administrative trends and problems within assigned area.

  • Mentors, trains and develops lower level procurement staff to assume more complex contract activity.

Position Requirements

  • Requires a Bachelor’s degree in business or related field and 8-12 years of relevant experience performing in a procurement or subcontract analysis, review, and administration position or equivalent years of education and experience.

  • Ability to draft moderate to complex, non-routine contractual instruments.

  • Demonstrated knowledge of Federal Acquisition Regulation and UCC procedures/transactions.

  • Adept at flowing down required FAR, DoD, and other federal agency clauses and provisions form prime contract to subcontract.

  • Demonstrated knowledge of corporate policies and procedures, coupled with ability to identify required improvement to established policies and to communicate implementation procedures to others.

  • Demonstrated knowledge of contracting concepts, Uniform Commercial Code, applicable public contract acquisition law and regulations, and applicable international contract law.

  • Demonstrated analytical and communication and presentation skills as well as negotiation skills

  • Proficient knowledge of procurement, sourcing, and implementing strategic purchasing programs

  • Strong financial analysis and project management skills.
